You see it all the time. Mexican restaurants with nothing but Mexicans working there, Chinese with only Chinese workers, etc. So what if person of a different race applies to a Mexican restaurant and is turned down for the fact that they're not Mexican? Is that illegal?
Just curious, it's not like I have an ambition to go sue a Mexican restaurant or anything. Is it illegal for racially themed restaurants to discriminate in hiring?
A lot of the time its a language issue. I asked my friend who owns a Chinese restaurant why only Chinese people worked as waitresses and he said "the chef only knows Chinese, so I need a Chinese waitress to tell him the order in Chinese." Obviously if someone was fluent in English and Chinese they'd find a much better job than a chef or waiter.
Lol it just hit me how weird it is you phrased the question. "Racially themed restaurant" like its a disney land where all the waiters have giant white people heads, or where you're eating Japanese people for dinner. I believe a better term would be ethnic cuisine
In the United States today, racism is ok as long as the target of the racism is whites. If the person being discriminated against is any other race, then it is wrong. But, you can discriminate against whites all you want and it's perfectly fine.
Some examples of racism that is accepted in America...
Affirmative Action.
B.E.T. (imagine a White Entertainment Television)
U.N.C.F. (imagine a United Caucasian College Fund)
N.A.A.C.P. (imagine a National Association for the Advancement of White People)
So, as long as you are not white, then you can file all kinds of civil suits for discrimination. But, if you're white, then anyone can discriminate against you and there is nothing you can do about it.Is it illegal for racially themed restaurants to discriminate in hiring?
No. An ethnic restaurant is trying to project a certain ethnic image, so they are legally allowed to hire people of that ethnicity for public areas. But they cannot discriminate for workers in areas that are not seen by the public (such as dishwashers and kitchen employees).
first you have to prove it and proving it will be very hard. when you hire you have a right to hire whom ever you want. i find it funny you would say this when whites had done this since they came to america. have you notice that??? why do you notice this in people of color, but yet whites do it all the time??? what do you call this practice by whites in america??? think about it...
Those are almost always family operations. And it's perfectly legal and legitimate for a family business to give hiring preference to their own family members.
You have to prove it though.
If one of the cretia of working is you have to speak chinese that isnt discrimiation
In the u.s. it is unlawful. However, demanding experience with the cuisine is not unlawful.
99% of the time it is family own. So therefore they keep the money by not hiring others.
It depends on the country and the state, but wearing a sombrero does help.
